I am a recently joined member of the ACLU. I have been very appreciative of the work the ACLU has done to curtail the unconstitutional changes the City of Denver has been attempting to put into place before the Democratic Convention comes to town.My question is this: Upon what underlying basis does the Mayor rely to declare an “extraordinary event” during which normal laws and procedures can be set aside? Is there any factual (legal) basis for this power? Are there any limitations on this power? Further, could the Mayor declare martial law in Denver?

While your question is an interesting one I truthfully do not know if I will be able to find an answer for you. Please know that I will attempt to find an answer from one of the two attorney’s here in the office. In the meantime you might be interested in knowing about a wonderful program put on by the Denver Channel 9 news that allows callers to phone in, speak to attorneys, ask questions and receive answers. The program is called Lawline 9 and it takes place on Wednesday afternoons between the hours of 4 – 6:30pm and the phone number is 303.698.0999.

Ms. May would serve well on the Mayor's staff. The Hick, of course--given this town's love affair with Hizzoner--shouldn't be questioned, shouldn't be second-guessed. If the Hick determines martial law to be appropriate given some notion there is an "extraordinary event" extant in the city, well then who are we, the People, to dare question the same. That this came from the ACLU with the suggestion you give a call to Channel 9 is one of those mind-blowing things akin to believing a call to 311 will actually provide results.
